Welcome to Crasme CRM, operated by Concaide. These Terms of Service ("Terms") govern your access to and use of the Crasme CRM platform, including all associated services, features, and applications. By accessing or using Crasme CRM, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By creating an account, accessing, or using Crasme CRM, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using Crasme CRM on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you must not access or use the platform. Continued use of Crasme CRM after any modifications to these Terms constitutes your acceptance of the revised Terms.
2. Description of Service
Crasme CRM is a comprehensive customer relationship management platform designed for field service and trades businesses. The platform includes, but is not limited to, the following features:
- CRM & Sales Management: Contact management, deal tracking, pipeline management, and lead management
- Dispatch & Scheduling: Job scheduling, technician dispatch, route optimization, and calendar management
- Quotes & Proposals: Configure-Price-Quote (CPQ) system, proposal generation, and digital acceptance
- Customer Portal: Self-service portal for customers to view quotes, invoices, tickets, and submit requests
- Time Clock & Workforce: Employee time tracking, attendance management, and hour approvals
- Invoicing & Billing: Invoice creation, payment tracking, and financial reporting
- Ticketing & Support: Service ticket management, customer communication, and issue tracking
- Reporting & Analytics: Dashboards, custom reports, and business intelligence
- Design Documents: Project documentation, concept management, and file attachments
- Email Integration: Gmail synchronization for unified communication management
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.
3. Account Registration and Security
To use Crasme CRM, you must create an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use of your account
- Ensuring that your account information is accurate and up to date
- Setting up appropriate security questions and recovery options
We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or that pose a security risk.
4. User Responsibilities and Acceptable Use
You agree to use Crasme CRM only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the platform to violate any applicable law, regulation, or third-party rights
- Upload, transmit, or distribute any malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to any part of the platform or its systems
- Interfere with or disrupt the integrity or performance of the platform
- Use automated tools, bots, or scripts to access the platform without our express permission
- Reverse engineer, decompile, or disassemble any aspect of the platform
- Share your account credentials with unauthorized individuals
- Use the platform to send spam, unsolicited messages, or engage in any form of harassment
- Store or transmit any content that is illegal, defamatory, or infringes on intellectual property rights
- Exceed any rate limits or usage restrictions applicable to your subscription plan
5. Subscription and Payment Terms
Crasme CRM is offered on a subscription basis. By subscribing, you agree to the following:
- Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan selected
- Payment: You authorize us to charge your designated payment method for subscription fees and any applicable taxes
- Price Changes: We may change our pricing at any time. Price changes will take effect at the start of the next billing cycle after notice is provided
- Refunds: Subscription fees are generally non-refundable except as required by applicable law or as otherwise specified in your subscription agreement
- Overdue Payments: If payment fails, we may suspend access to your account until the outstanding balance is resolved
- Cancellation: You may cancel your subscription at any time. Access will continue until the end of the current billing period
6. Intellectual Property Rights
All intellectual property rights in and to Crasme CRM, including but not limited to the software, design, logos, trademarks, documentation, and all related materials, are owned by Concaide or its licensors. These Terms do not grant you any right, title, or interest in the platform except for the limited right to use it in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of the platform, nor may you reverse engineer or attempt to extract the source code of the software, unless laws prohibit these restrictions or you have our written permission.
7. Data Ownership
You retain full ownership of all data that you and your authorized users input into Crasme CRM ("Customer Data"). Specifically:
- All contacts, companies, deals, tickets, quotes, invoices, and other business data you create belong to you
- We will not access, use, or share your Customer Data except as necessary to provide and improve our services, or as required by law
- You may export your Customer Data at any time through the platform's export functionality
- Upon termination of your account, we will retain your Customer Data for a reasonable period to allow for data export, after which it will be securely deleted
By using Crasme CRM, you grant us a limited, non-exclusive license to use your Customer Data solely to provide, maintain, and improve our services.
8. Service Availability and Uptime
We strive to maintain high availability of Crasme CRM and aim for 99.9% uptime. However, we do not guarantee uninterrupted access to the platform. The service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency maintenance to address security or critical issues
- Factors beyond our reasonable control, including natural disasters, internet service disruptions, or third-party service outages
We will make commercially reasonable efforts to minimize downtime and communicate any service disruptions promptly.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Crasme CRM and Concaide shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill
- Our total aggregate liability for any claims arising from or related to these Terms or the use of the platform shall not exceed the total fees paid by you during the twelve (12) months preceding the claim
- We are not liable for any damages resulting from unauthorized access to or alteration of your data, or from any third-party conduct on the platform
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Concaide, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of Crasme CRM
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Any Customer Data you input into the platform
- Any dispute between you and a third party related to your use of the platform
11. Termination
Either party may terminate these Terms as follows:
- By You: You may terminate your account at any time by canceling your subscription and contacting us to request account deletion
- By Us: We may suspend or terminate your access to Crasme CRM at any time if you violate these Terms, fail to pay applicable fees, or if we determine that your use poses a risk to the platform or other users
- Effect of Termination: Upon termination, your right to access the platform ceases immediately. We will retain your data for a reasonable period (typically 90 days) to allow you to export your information
Sections that by their nature should survive termination shall remain in effect, including but not limited to Intellectual Property Rights, Limitation of Liability, Indemnification, and Dispute Resolution.
12. Dispute Resolution
Any disputes arising out of or relating to these Terms or the use of Crasme CRM shall be resolved as follows:
- Informal Resolution: The parties shall first attempt to resolve any dispute informally by contacting each other directly. You may reach us at support@crasme.com
- Mediation: If the dispute cannot be resolved informally within 30 days, the parties agree to attempt resolution through mediation before pursuing arbitration or litigation
- Arbitration: If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in accordance with applicable arbitration rules
- Class Action Waiver: You agree that any disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal proceedings arising out of or relating to these Terms shall be brought exclusively in the courts of competent jurisdiction.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email or through a prominent notice within the platform at least 30 days before the changes take effect
- Provide a summary of the key changes for your convenience
Your continued use of Crasme CRM after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the platform and close your account.
